Now imagine it being tightly wrapped up in Intellectual Property (IP) protection. For its own good, mind you. It safeguards films, TV series, songs, screenplays, set design, and so much more. You can read more about copyright in films, in our previous blog post<a href=\"https:\/\/blog.lboro.ac.uk\/rdm\/2025\/06\/popcorn-and-permissions-understanding-film-licensing-for-uk-higher-education-screenings\/\">, Popcorn and Permissions: Understanding Film Licensing for UK Higher Education Screenings<\/a>. As an example, copyright law makes sure that a film is protected from unauthorized distribution and duplication, basically protection against piracy. That doesn\u2019t mean piracy does not happen, but it does mean that those who pirate can be held responsible and their <a href=\"https:\/\/www.theverge.com\/2024\/8\/29\/24231552\/fmovies-aniwave-alliance-for-creativity-and-entertainment-piracy?utm_source=substack&amp;utm_medium=email\">sites shut down<\/a>.<\/p>\n\n\n\n<p>Other IP protection within the entertainment industry are trademarks, patents, design rights and of course performers rights. Let\u2019s have a quick look at those:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trademarks \u2013 trademark registration makes sure that certain products and services will be associated with that specific brand. <a href=\"https:\/\/www.tmdn.org\/tmview\/#\/tmview\/results?page=1&amp;pageSize=30&amp;criteria=C&amp;basicSearch=Star%20Wars\">Star Wars<\/a> is a registered trademark, as such most consumers will associate anything with the Star Wars name to the Star Wars brand, like Star Wars Rogue One. Also to note here, that <a href=\"https:\/\/www.tmdn.org\/tmview\/#\/tmview\/detail\/MX501985011792901\">Star Wars Rogue One<\/a> is also a registered trademark. Sometimes, characters and character names can be trademarked. While Cassian Andor is not a trademarked name, <a href=\"https:\/\/www.tmdn.org\/tmview\/#\/tmview\/results?page=1&amp;pageSize=30&amp;criteria=C&amp;basicSearch=HAN%20SOLO\">Han Solo<\/a> is. \u00a0\u00a0\u00a0<\/li>\n\n\n\n<li>Patents \u2013 protect innovations and other \u2018creations of the mind\u2019. For example, did you know that Lucasfilm <a href=\"https:\/\/www.linkedin.com\/posts\/uspto_star-wars-patents-activity-7324798858566197250-XLlO\/\">registered<\/a> its very first design patents for a <a href=\"https:\/\/patents.google.com\/patent\/USD264109S\/en\">toy figurine based on Boba Fett<\/a> in 1982?! However, not just characters are patented from a galaxy far, far away, but also things like <a href=\"https:\/\/patents.google.com\/patent\/US9424679B2\/en?assignee=Lucasfilm&amp;oq=Lucasfilm\">three-dimensional motion capture<\/a>.<\/li>\n\n\n\n<li>Design rights \u2013 protect the visual appearance of a product. Here we can look at <a href=\"https:\/\/www.youtube.com\/watch?v=1vx5GkwYkZQ\">set designs<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=1X-5fZN7HSU\">costumes<\/a>, blasters, X-wings and TIE fighters.<\/li>\n\n\n\n<li>Performer\u2019s rights \u2013 are non-property rights and property rights, relating to live and recorded performances, and moral rights. Some similar rights are given to companies with exclusive recording contract with the performer. This type of rights exists for performances made in, or by subjects or residents of the UK, Channel Islands, the Isle of Man, Gibraltar or one of the British Overseas Territories. Same applies to any member state of the EEA. For performers and performances made in other countries, the level of protection depends on whether the country is a signatory of different treaties or if the country is a member of the World Trade Organisation (WTO). Examples here can be <a href=\"https:\/\/www.youtube.com\/watch?v=KYnE2Mxayco\">Genevieve O\u2019Reilly\u2019s performance as Mon Mothma<\/a> or <a href=\"https:\/\/www.youtube.com\/watch?v=1Cz6h4FeTsk\">Diego Luna\u2019s performance as Cassian Andor<\/a>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Lucasfilm\u2019s Legacy and IP Strategy<\/strong><\/p>\n\n\n\n<p>In 1971, filmmaker George Lucas founded <a href=\"https:\/\/en.wikipedia.org\/wiki\/Lucasfilm#Independent_era_(1971%E2%80%932012)\">Lucasfilm<\/a> and incorporated it as Lucasfilm Ltd. in 1977. Lucas also founded the Star Wars Corporation, Inc. as a subsidiary to control the various legal and financial aspects of Star Wars, like copyright and sequel and merchandising rights. In subsequent years, the subsidiary was absorbed into various Lucasfilm divisions.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-scaled.jpg\" rel=\"lightbox[833]\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"317\" src=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-1024x317.jpg\" alt=\"\" class=\"wp-image-836\" srcset=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-1024x317.jpg 1024w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-300x93.jpg 300w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-768x238.jpg 768w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-1536x476.jpg 1536w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_157921710-2048x635.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p>To protect the <a href=\"https:\/\/kass.asia\/star-wars-intellectual-property\/\">IP spawning from a Galaxy, Far, Far Awa<\/a>y, many things, from characters, planets, space tech devices, and vehicles, be it flying ones or terrestrial ones, have been registered as a trademark by Lucasfilm Ltd. Other trademarks include but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Characters &#8211; Luke Skywalker, Yoda, Darth Vader, etc.;<\/li>\n\n\n\n<li>Species &#8211; \u201cWookie\u201d or \u201cEwok\u201d;<\/li>\n\n\n\n<li>Phrases such as \u201cMay the Force be with you\u201d or \u201cMay the 4<sup>th<\/sup> be with you\u201d and \u201cMay the Fourth be with you\u201d;<\/li>\n\n\n\n<li>Generic terms \u2013 bounty hunter. We are also a bit confused about the last one, generic terms are usually not trademarked, but it seems the Force is strong with this one.<\/li>\n<\/ul>\n\n\n\n<p>All in all, <a href=\"https:\/\/suiter.com\/may-the-force-be-with-star-wars-intellectual-property\/\">Lucasfilm has over 205 patents<\/a>, 1,077 individual trademark applications and 3,489 registered copyright (in the US you can register copyright, not required in the UK).<\/p>\n\n\n\n<p>Registering all this <a href=\"https:\/\/kass.asia\/star-wars-intellectual-property\/\">IP is not only to continue to protect the Empire<\/a> but also to be able to create a plethora of merchandise, from toys, video games, comic books, clothing and <a href=\"https:\/\/regalrobot.com\/custom-starwars-furniture-art-decor\/\">furniture<\/a>. I mean who doesn\u2019t want a <a href=\"https:\/\/regalrobot.com\/shop\/star-wars\/custom-starwars-furniture\/millennium-falcon-pilot-rolling-desk-chair\/\">Millenium Falcon rolling desk chair<\/a>?!<\/p>\n\n\n\n<p><strong>Disney\u2019s Acquisition and Expansion<\/strong><\/p>\n\n\n\n<p>Disney <a href=\"https:\/\/en.wikipedia.org\/wiki\/Lucasfilm#Acquisition_process\">acquired<\/a> Lucasfilm Ltd. in 2012, after George Lucas announced his intention to retire. Under the deal, Disney acquired the Star Wars and Indiana Jones franchises, as well as Lucasfilm&#8217;s operating businesses in live-action film production, consumer products, video games, animation, visual effects, and audio post-production.<\/p>\n\n\n\n<p>Disney continued the expansion of the Star Wars universe, with some standalone films, like <a href=\"https:\/\/en.wikipedia.org\/wiki\/Rogue_One\">Rogue One (2016)<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Solo:_A_Star_Wars_Story\">Solo: A Star Wars Story (2018)<\/a>. Rogue One has seen a <a href=\"https:\/\/screenrant.com\/star-wars-rogue-one-rewatch-after-andor\/\">resurgence<\/a> after the last episode of <a href=\"https:\/\/www.starwars.com\/series\/andor\">Andor<\/a> Season 2. I must admit, the first thing I said after we watched the last episode of Andor was, \u201cWe are watching Rogue One this weekend\u201d. \u00a0<\/p>\n\n\n\n<p>After the mixed response of Solo at the box office, there was a slowdown in release of new Star Wars films, and Disney concentrated more on developing content for their Disney+ streaming service, launching shows like <a href=\"https:\/\/www.starwars.com\/series\/the-mandalorian\">The Mandalorian<\/a>, <a href=\"https:\/\/www.starwars.com\/series\/star-wars-ahsoka\">Ahsoka<\/a> and <a href=\"https:\/\/www.starwars.com\/series\/star-wars-skeleton-crew\">Skeleton Crew<\/a>.<\/p>\n\n\n\n<p>And so, the expansion of the IP Empire continues, with more new characters for <a href=\"https:\/\/www.disneystore.co.uk\/toys-and-fancy-dress\/toys\/action-figures?page=2\">action figures<\/a>, <a href=\"https:\/\/www.disneystore.co.uk\/characters-and-movies\/star-wars\/star-wars-products?prefn1=a2000002&amp;prefv1=Toys#product-search-results\">toys<\/a> and <a href=\"https:\/\/www.lego.com\/en-gb\/themes\/star-wars\">LEGO<\/a>. &nbsp;<\/p>\n\n\n\n<p><strong>Case Studies and Controversies<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/dockets.justia.com\/docket\/california\/candce\/3:2016cv05968\/304156\/\"><strong>Lucasfilm Ltd. LLC et al v. Brown<\/strong><\/a><\/p>\n\n\n\n<p>Lucasfilm Ltd. LLC, a subsidiary of Disney, took Michael Brown to court in 2016 over trademark infringement of the <a href=\"https:\/\/www.thebrandprotectionblog.com\/2016\/10\/these-arent-the-trademarks-youre-looking-for-lucasfilm-sues-lightsaber-academy-for-infringement\/\">Jedi logo<\/a>, as well as false designation of origin, federal trademark dilution, cybersquatting and many other claims under Californian state laws. Michael Brown operated a business called New York Jedi, the Lightsaber Academy and Thrills and Skills. The Academy would teach people the way of the Jedi, and how to wield a lightsaber.<\/p>\n\n\n\n<p><a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/622\/931\/2395863\/\"><strong>Lucasfilm Ltd. v. High Frontier<\/strong><\/a><\/p>\n\n\n\n<p>In 1985, Lucasfilm took the Ronald Reagan administration to court following their use of the term \u201cStar Wars\u201d in relation to the development of a space-based laser that would shoot down incoming ballistic missiles launched from the Soviet Union(yes, you did read that right). In the media, the plan was referred to as \u201cStar Wars\u201d.\u00a0Lucasfilm took the company working with the Reagan administration, High Frontier, to court over <a href=\"https:\/\/www.kleinlitigation.com\/that-one-time-when-lucasfilm-sued-president-reagans-star-wars-program\/\">trademark infringement<\/a>. Unfortunately, it lost the case as the judge concluded the term \u201cStar Wars\u201d was used as a parody.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.robcorbettlaw.com\/post\/lucasfilm-v-ainsworth-the-battle-over-the-stormtrooper-helmet#:~:text=Lucasfilm's%20Legal%20Action&amp;text=In%20the%20US%2C%20the%20courts,producing%20and%20selling%20the%20helmets.\"><strong>Lucasfilm Ltd. v. Ainsworth<\/strong><\/a><\/p>\n\n\n\n<p>In 2004, Lucasfilm took Andrew Ainsworth, a prop designer from the UK, who originally designed and manufactured the stormtrooper helmets and armour used in the 1977 film \u201cStar Wars: A New Hope\u201d. He started selling replicas in the UK and globally which caused Lucasfilm to sue for copyright infringement. This case is interesting in highlighting the territoriality of copyright. While the US court sided with Lucasfilm, in the UK, Ainsworth <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-14287864\">successfully argued<\/a> that the suits are utilitarian in nature as such copyright does not apply (copyright does not apply to objects which are utilitarian, or have a purpose, like chairs). Meaning simply, that he can continue to sell the replicas anywhere in the world, except the US.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-scaled.jpg\" rel=\"lightbox[833]\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"444\" src=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-1024x444.jpg\" alt=\"\" class=\"wp-image-843\" srcset=\"https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-1024x444.jpg 1024w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-300x130.jpg 300w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-768x333.jpg 768w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-1536x665.jpg 1536w, https:\/\/blog.lboro.ac.uk\/rdm\/wp-content\/uploads\/sites\/9\/2025\/08\/AdobeStock_236627350-2048x887.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<p><strong>The Future of IP in a Galaxy Far, Far Away<\/strong><\/p>\n\n\n\n<p>With more <a href=\"https:\/\/www.ign.com\/articles\/upcoming-new-star-wars-movies-2025-tv-shows-release-dates\">films and series coming near you from the Galaxy Far, Far Away<\/a>, we are sure that there will be more characters and designs to love and protect. Disney, and Lucasfilm, have a good knowledge of how to protect their IP and create new characters to love and protect. Oh, and did I mention all the cool and cute merch?!<\/p>\n\n\n\n<p>Whether you are a fan or just discovering the beautiful and terrifying worlds, of a Galaxy Far, Far Away, you will not be disappointed by the sheer imagination, the amazing set designs, the fantastic costume designs, the performances of the actors, be it that they are recognizable as humans or are just very funny droids (<a href=\"https:\/\/www.youtube.com\/watch?v=_XFna-tONYo\">K-2SO played by Alan Tudyk<\/a>). And as boring as it all sounds, and as frustrating as it can sometimes feel, all of these are rightfully protected by a vast array of IP rights. What does the future hold for a Galaxy Far, Far Away?! Well, as Master Yoda said so wisely, in <em>The Empire Strikes Back, \u201c<\/em>Difficult to see; always in motion is the future<em>\u201d.<\/em><\/p>\n\n\n\n<p><strong>Welcome to the Rebellion! (<em>Cassian Andor, in Andor, ep.9, Season 2)<\/em><\/strong><\/p>\n\n\n\n<p>Small businesses and fans often unknowingly infringe on Disney and Lucasfilm\u2019s IP, and there are many voices that bemoan the way Disney and its subsidiaries protect their IP. However, when films like <a href=\"https:\/\/www.rottentomatoes.com\/m\/winnie_the_pooh_blood_and_honey\">Winnie-the-Pooh: Blood and Honey<\/a> are created, can you really hold it against them?! As one critic of Blood and Honey put it: <em>Makes you wish the Supreme Court would repeal its public domain copyright laws.<\/em> Another critic made their view very clear as well, stating: <em>There aren&#8217;t any copyright issues with the material but [Rhys Frake-Waterfield] has no right to do what he did with it.<\/em><\/p>\n\n\n\n<p>So, what is there to do?! In more general terms, respect other people\u2019s IP (especially if it is still protected, but also maybe just a little bit, if it isn\u2019t) quoting Yoda, from the Empire Strikes Back: \u201cDo. Or do not. There is no try.\u201d<\/p>\n\n\n\n<p>Lucasfilm Ltd. LLC have worked hard for the world in Star Wars, and it is their right to protect it, tooth and nail. Don\u2019t believe me?
